What Is Chapter 7 Bankruptcy?

Chapter 7 bankruptcy, also known as liquidation bankruptcy, is the legal process that may allow you to discharge qualifying unsecured debts such as the following:

  • Medical bills
  • Utility bills
  • Past-due rent
  • Personal loans
  • Credit card charges

Trustee Review & Louisiana Exemptions

Once you file for Chapter 7, your case will be assigned to a bankruptcy trustee who will review your petition, schedules, assets, and exemptions. Any nonexempt property may be administered for the benefit of creditors, while exempt assets may be protected under bankruptcy law.

In Louisiana, a considerable amount of personal property is exempt during Chapter 7 bankruptcy. This includes an exemption of up to $35,000 of equity for your residential home and, under Louisiana law, up to $15,000 equity for your motor vehicle (effective August 1, 2026 under Act 55; confirm the applicable standard for your filing date). Other exemptions may include personal property like furniture, household goods, musical instruments, pets and other animals, qualified pensions, annuities, a portion of your disposable wage earnings, and other miscellaneous categories, subject to statutory limits and conditions.

Debt Discharge

One of the main advantages of Chapter 7 bankruptcy is that it may allow you to discharge most qualifying unsecured debts, giving you a path toward a fresh financial start. However, not all debts can be discharged through Chapter 7. For example, student loans, child support, domestic-support obligations, and certain tax debts are generally non-dischargeable, and other statutory exceptions may apply.

Chapter 7 Eligibility

Chapter 7 not only provides an avenue for tackling insurmountable financial challenges but also imposes certain eligibility criteria that applicants must meet. This includes a means test designed to ensure that your financial situation merits relief. Understanding how these factors align with your unique circumstances can be crucial in making informed decisions. As your Chapter 7 bankruptcy lawyer in Metairie, I can guide you throughout the process.

Who Is Eligible for Chapter 7?

To qualify for Chapter 7, you must pass the “means test.” This test compares your current monthly income with the median income for a similar household in Louisiana. If your income is lower than the median, you may qualify without additional means-test calculations.

Means-Test Calculations

However, if your income exceeds the median, you may still qualify through additional calculations applied to the means test. These calculations consider your “disposable income” (the amount left after subtracting certain allowed expenses from your monthly income). The means test uses national and local expense standards set by the IRS as well as other permitted deductions; the result can affect whether a presumption of abuse arises in your case. Because the U.S. Trustee’s means-test data is updated periodically, the income thresholds and expense standards that apply depend on your actual filing date.

These expenses include standard national, local, and regional allowances for living expenses such as food, clothing, housing, utilities, transportation, taxes, and payments for mandatory obligations like child support.

Chapter 13 Repayment Plans

If deducting these amounts shows that you have enough disposable income to repay some unsecured debts over a five-year repayment period, you may not qualify for Chapter 7 bankruptcy. You might still qualify if your income is higher based on certain expenses and financial situations. However, failing the means test doesn’t leave you without options. You might still be eligible to repay some of your debts through a three- to five-year Chapter 13 repayment plan.

Credit Counseling & Debtor Education

Aside from financial qualifications, there are also responsibilities you must meet before and after filing. Individual debtors are generally required to complete an approved credit counseling course before filing and a personal financial management course after filing in order to receive a Chapter 7 discharge. Successfully managing these requirements is important to eligibility for a discharge and the debt relief you seek.

Understanding the Chapter 7 Bankruptcy Process

Filing for Chapter 7 bankruptcy can be complex and overwhelming, but it can also provide the financial relief you need. As your Metairie Chapter 7 bankruptcy lawyer, I can guide you through every step and explain your rights and options. Chapter 7 cases are filed with the United States Bankruptcy Court for the Eastern District of Louisiana, and the process involves preparing and submitting a petition, schedules, and supporting financial documentation.

When you file for Chapter 7 bankruptcy, you can expect:

  • Automatic stay: Once you file for Chapter 7 bankruptcy, an automatic stay generally goes into effect, requiring creditors to stop collection actions (including phone calls, letters, and lawsuits), subject to statutory exceptions and possible court orders.
  • Trustee review & 341 meeting: A bankruptcy trustee reviews your petition, schedules, and exemptions. You will also attend a 341 meeting of creditors, where the trustee and any creditors may question you about your debts, property, and the information in your bankruptcy papers.
  • Debt discharge: In a Chapter 7 bankruptcy, most qualifying unsecured debts, such as credit card debt and medical bills, may be discharged, which releases your personal liability for those debts. A discharge does not eliminate valid liens against collateral and does not cover every category of debt. Discharge commonly occurs approximately four months after filing when no complications arise, though timing varies by case.
  • Asset administration: A trustee will review your assets and applicable exemptions. Property that is not protected by an exemption may be administered for creditors’ benefit. Exempt property, such as your home equity up to the applicable limit and your vehicle up to the applicable exemption, may be protected.
  • Credit counseling & debtor education: Before filing for Chapter 7 bankruptcy, you must complete an approved credit counseling course. After filing, you must also complete a personal financial management course within the applicable deadline to receive your discharge.

Each stage of the bankruptcy process is governed by specific timelines and legal procedures, making it essential to have professional guidance. You must provide complete and accurate information about your income, expenses, assets, debts, and property interests throughout. Failure to comply can result in delays or dismissal of your bankruptcy petition. It’s important to maintain open communication with your legal representative to provide accurate information and respond to requests promptly, supporting smoother navigation through the court system.

I aim to help you work toward financial stability and start a new chapter in your life. If Chapter 7 isn’t the right solution for you (whether because of income, assets, or other circumstances), I can look into other options, including filing for Chapter 13 bankruptcy, which involves a court-approved repayment plan that typically lasts three to five years. The appropriate path depends on your individual income, household circumstances, debts, and financial goals.
